法的な位置づけ
外国の当局から「Notary Public の認証を取得してほしい」と求められた場合、タイでは登録公証弁護士による認証がこれに相当します。認証されるのは、署名が本人によって目の前で行われた事実、写しが原本と一致する事実、宣誓が行われた事実といった「事実」であり、書類の中身の真偽や法的効力そのものではありません。

取締役の署名認証と登記事項証明の写し認証を揃え、設立地の法務局や登記所に提出できる形に整えます。

会社存続証明や財務書類の写しに認証を付し、取引先の内部審査に耐える体裁で提出します。

婚姻状況の宣誓書、在職証明、収入証明などを、大使館が指定する形式に合わせて準備します。

対応形式
バンコクの事務所で本人確認を行い、その場で署名と認証を完了します。所要は通常30〜60分です。
病院・工場・ホテルなど、署名者が移動できない場所へ弁護士が伺います。移動範囲は事前にご相談ください。
取締役が複数名いる場合や書類が多い案件では、署名手順と日程を設計し、まとめて処理します。
認証後の外務省領事局・大使館提出を代行し、受領までの進捗をご報告します。
手続の流れ
提出先の指示書やメールを共有していただき、必要な認証の種類と文言を特定します。この段階で不足書類を洗い出します。
認証文と書類本体を用意し、必要に応じて翻訳を手配します。原本の持参が必要かどうかもご案内します。
署名者が弁護士の面前でパスポート等を提示し、その場で署名します。代理署名は認められません。
認証文・署名・押印を付し、事務所の公証記録簿に登録します。控えは保管され、後日の照会に対応できます。
必要に応じて外務省領事局と大使館へ提出し、完了後に書類をお渡しまたは発送します。
所要期間
以下は実務上の目安です。官公庁と大使館が担当する工程は、各機関の運用と混雑状況によって変動します。

お急ぎの案件では署名と提出を優先して進めますが、領事局や大使館の待ち時間など当方の管理外の工程については、確約ではなく実績にもとづく目安としてお伝えします。
領事認証
タイはハーグ条約(アポスティーユ条約)の締約国ではないため、アポスティーユは発行されません。国外で使用する書類は、登録弁護士の認証、外務省領事局の認証、提出先国の在タイ大使館の認証、という順に進めるのが一般的です。
ステップ 1

上記は当事務所の取扱実績にもとづく一般的な傾向です。最終的な要件は、提出先の当局または大使館の指示が優先します。

却下事例
ご予約の前に、当方では次の点を必ず確認します。いずれも領事局や提出先当局から差し戻される典型的な理由です。
パスポートと書類上の綴りが一文字でも異なると、同一人物と認められないことがあります。
署名認証は面前が原則です。代理での署名や事後の認証はできません。
指定書式がある場合、汎用の文言では受理されないことがあります。
外務省の認証を飛ばして大使館へ提出すると、受付段階で戻されます。
翻訳者の資格や綴じ方の指定を満たしていない事例が多くあります。
発行から一定期間内の書類を求める提出先では、再取得が必要になります。
実務基準
用語集
外国の当局が使う表現と、タイの実務上の名称は一致しないことがあります。最初のご連絡で必要な認証を特定するためにご活用ください。
よくある質問
独立した公証人制度はありません。タイ弁護士会に登録した弁護士が、認証業務を担当します。海外で Notary Public の認証を求められた場合は、この登録弁護士の認証が対応します。
できません。タイは条約に加盟していないため、外務省領事局と提出先国の大使館による認証という経路をとります。
署名認証は面前が必要です。渡航が難しい場合は、居住国の公証制度を利用する方法や、委任状を活用する方法をご案内します。
対応します。必要に応じて日本語・英語・タイ語の翻訳を手配し、翻訳者の署名認証まで行います。
書類の種類、通数、翻訳の要否、後続手続の範囲によって変わります。指示書をお送りいただければ、内訳を明示した見積をご提示します。
認証自体は当日中に完了します。領事局と大使館の工程を含む場合は、通常1〜3週間程度を見込んでください。
記録簿に登録があるため、同一内容での再認証をご相談いただけます。原本の再提示が必要になる場合があります。
弁護士の守秘義務にもとづき、業務目的以外には使用しません。必要に応じて秘密保持契約の締結にも対応します。
